PRIVACY POLICY

Kboodle, LLC (“we,” “our,” or “us”) respects and is committed to protecting your privacy. This Privacy Policy explains how and for what purposes we collect, process, and use your Personal Information and Usage Information (each as defined below).

This Privacy Policy applies to our website at https://kboodle.com/, our mobile application(s), and any related online features, products, services, and programs we offer (collectively, the “Services”). It does not apply to any website, application, or service owned or operated by anyone other than us.

Your use of the Services is also governed by our Terms of Use.

Types of Information Collected

Personal Information we collect may include:

  • Account information — your name, email address, password, phone number (if provided), and billing information (processed through our payment processor).
  •  Content you provide — the photos, videos, audio, and written stories, captions, and descriptions you upload to create Albums, along with metadata associated with that content (such as date, time, and any location data embedded in the file).
  •  QR Pictures data — information generated when you create a QR Picture, including the unique code assigned to it and the digital content it links to.
  •  Communications — information you provide when you contact customer support or otherwise correspond with us.


Usage Information we collect may include:

  • IP address or device ID, browser type and language:

  • pages visited, time spent, and click activity;

  • HTTP headers, operating system, and similar technical data; and
  • aggregated, non-identifying usage statistics.


How Information Is Collected

We may collect information from:

  • correspondence you send us, including emails to support;
  • information you provide when creating a User Account or completing onboarding/profile forms;
  • your use of the Services, including uploading content and creating Albums;
  • your transactions with us or with third-party payment processors;
  • information we receive from your computer or mobile device; and
  • information we receive from service providers, as permitted by applicable law.


If you sign up for our mailing list, we may send you occasional emails about the Services. You can unsubscribe at any time using the link in that communication.

We also collect Usage Information through:

Cookies. We may use cookies to keep track of your visit and improve your experience on the Services. You can control cookies through your browser settings, though some functionality may not work properly without them.

Web Beacons. Some pages or emails may contain small tracking images (“web beacons”) that collect limited technical information, such as a cookie identifier and the date/time of a page view. These do not carry Personal Information.

Location Information. Photos and videos you upload may contain embedded location data (such as GPS coordinates) that we use, if you enable this feature, to help organize your Albums chronologically and geographically. If you use our mobile app, we may request permission to access your device’s location for similar purposes. You can control location access through your device settings and can remove location metadata from files before uploading.

Unique Identifier. We may assign an internal identifier to your account to recognize you on future visits, personalize your experience, and compile aggregate usage statistics.

AI Processing and Third-Party Service Providers

Certain features of the Services use artificial intelligence to assist with organizing photos and generating suggested story descriptions. To provide these features, photos, videos, and text you submit for that purpose are transmitted to a third-party AI processing provider.

We also use a third-party provider for hosting, storage, content delivery, and security of the Services.

These providers are contractually required to process your information only to perform the services we’ve engaged them for, and consistent with this Privacy Policy and applicable law. We may add, remove, or change service providers over time. A current list of our key service providers is available on request by emailing support@kboodle.com.


Use of Collected Information

We use collected information to:

  • provide and improve the Services, including Album creation and organization;
  • power AI-assisted features, such as suggested story descriptions and photo processing;
  • generate, maintain, and link QR Pictures to your digital content;
  • personalize your experience;
  • communicate with you about your account and the Services; and
  • protect the safety, security, and integrity of the Services and our users.


When Information Is Disclosed and Shared

We may disclose Personal Information or Usage Information when required by law or in the good-faith belief that disclosure is necessary to:

  • comply with legal process or applicable law;
  • enforce this Privacy Policy or our Terms of Use;
  • respond to claims that content violates a third party’s rights;
  • assist government or law enforcement agencies; or
  • protect the rights, property, or safety of our users or the public.


We share Personal Information with hosting partners and other trusted service providers who help operate the Services (see “AI Processing and Third-Party Service Providers” above). We require these parties to handle your information consistent with this Policy or applicable privacy law. We do not sell your Personal Information.

We may share aggregated, anonymized, non-identifying information with others for analytics or business purposes.

If Kboodle is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.

We may also disclose your Personal Information with your permission or as directed by you.

Security

We use reasonable technical and administrative safeguards to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Shared Albums and Comments

Certain features may allow you to invite others — such as family members — to view, comment on, or contribute to a shared Album. Content and comments within a shared Album are visible to everyone you’ve invited to that Album. Please use discretion when sharing personal information within a shared Album, as we can’t control how invited participants may further use or disclose that information.

Information from Children

The Services are not directed to children under thirteen (13), and we do not knowingly collect Personal Information directly from children through our account registration process. You must be at least eighteen (18) years old, or an emancipated minor, to create a User Account.

Many of our users are parents and guardians who use the Services to store, organize, and share photos, videos, and stories that include images of their own minor children. By uploading such content, you represent that you have the legal right and appropriate authority to do so and to consent to our processing of that content as described in this Policy and our Terms of Use.

We do not tolerate child sexual abuse material (CSAM). Where legally required, we report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement.

Privacy Outside the Services

The Services may contain links to third-party websites or social media platforms. We are not responsible for the privacy practices or content of those sites. Please review their privacy policies directly.

European Union Users

The Services are hosted in the United States and governed by U.S. law. If you use the Services from outside the U.S., your information may be transferred to and processed in the United States.

We process Personal Information only where we have a legal basis to do so — including your consent, the performance of a contract with you, compliance with legal obligations, or our legitimate interests.

Subject to applicable law, you may have the right to: (1) request information about the Personal Information we hold about you; (2) request rectification, deletion, or restriction of processing; (3) request a copy of Personal Information you’ve provided to us; and (4) withdraw consent at any time where processing is based on consent. To exercise these rights, contact us using the information at the end of this Policy.

Choices and Opting Out

Providing Personal Information to us is voluntary, though some Services may be unavailable without it. You may opt out of certain uses of your Personal Information by contacting us using the information below. Some uses are necessary to provide the Services you’ve requested and cannot be opted out of.

Access and Correction

To access, correct, or request deletion of your Personal Information, contact us using the information at the end of this Policy. We may ask you to verify your identity before processing such requests.

Your California Privacy Rights

Shine the Light. Under California’s “Shine the Light” law, California residents may request, once per calendar year, information about any Personal Information we’ve shared with other businesses for their own direct marketing purposes. To make a request, email support@kboodle.com with “Request for California Privacy Information” in the subject line.

CCPA/CPRA. California residents have the right to: (1) know what Personal Information we’ve collected, used, and disclosed about you; (2) request deletion, subject to certain exceptions; (3) request correction of inaccurate information; (4) opt out of the “sale” or “sharing” of Personal Information, if applicable; (5) limit use of Sensitive Personal Information; and (6) not be discriminated against for exercising these rights. We do not sell Personal Information for money. You may opt out of any sharing that could be considered a “sale” or “share” under California law by emailing support@kboodle.com. We honor opt-out preference signals such as the Global Privacy Control where legally required. You may designate an authorized agent to submit a request on your behalf, subject to verification.

Other State Laws. Residents of other U.S. states with comprehensive privacy laws (such as Virginia, Colorado, and Connecticut) may have similar rights. Contact us using the information below to exercise them.

Civil Code Section 1789.3. The Services are owned and operated by Kboodle, LLC and provided on a subscription basis as described in our pricing. “Do Not Track” Signals

Your browser may let you transmit a “Do Not Track” signal. We do not currently alter our practices in response to that signal, though we do honor the Global Privacy Control and other recognized opt-out signals as described above. Learn more at http://www.allaboutdnt.com.

Data Retention

We retain Personal Information and User Content for as long as your account is active, and for a reasonable period afterward to allow reactivation, comply with legal obligations, resolve disputes, and enforce our agreements.

If you close your account or request deletion, we will delete or anonymize your Personal Information and User Content within 30 days, except where we’re required to retain certain records longer (e.g., billing records), or where content has already been saved by other users within a shared Album.

If your subscription lapses due to non-payment, your account and content are instead retained in a frozen, non-shareable state to allow you to reactivate before permanent deletion, as described in our Terms of Use.

Your Consent to This Privacy Policy

By using the Services, you consent to the collection and use of your information as described in this Policy. We’ll post any changes to this page. Continued use of the Services after changes take effect signifies your acceptance of the revised Policy.
